TEAMBOX TERMS OF USE

1. CONSENT AND ACCEPTANCE OF TERMS OF USE
1.1 These Terms of Use (hereinafter referred to as the “Terms of Use”) for Teambox govern the relationship between the users and Teambox.

1.2 By continuing to use Teambox, you accept the Terms of Use. Unfortunately, if you do not accept the terms, you can not use Teambox.

1.3 By accepting the Terms of Use, you give your consent for Teambox to process your data.

1.4 If you are under 13 years of age, you must have your parents’ prior consent to use Teambox.

1.5 It is recommended that you save the Terms of Use.

2. ABOUT TEAMBOX
2.1 Teambox is a mobile app (hereinafter referred to as the “Platform”), which can be used free of charge to keep track of the accounts in communities, including fines.

3. USER ACCOUNT
3.1 To use the Platform, you must create a user account.

3.2 You can find information about Teambox ‘handling of your personal information in connection with your use of the Platform and your rights in accordance with the applicable law on data protection in Teambox’ current Personal Data Policy.

3.3 It is your own responsibility that the information in your user account is correct and up to date. Teambox has no responsibility for the consequences of incorrect information in the user account.

3.4 When creating a user account, you must select a password. Your password is personal and confidential.

3.5 Should you experience misuse, or if you suspect misuse, of your password or user account, you must immediately contact Teambox at the above address or e-mail address.

4. DELETION OF USER ACCOUNT
4.1 If you wish to delete your user account, this must be done under ‘Edit Profile’ on the Platform, which you will find by clicking the settings button in the top right corner.

4.2 Deleting your user account requires active action on your part. Your user will be permanently deleted and all data will be removed from our database.
In the event that your user has been inactive, including not being logged in, for more than 12 month, your user account will be deleted by Teambox.

5. RIGHTS
5.1 Teambox has all rights, including ownership and copyright, to Teambox.

5.2 By accepting the Terms of Use, you obtain a time-limited, non-exclusive and revocable right to use the Platform. The right to use is conditional on you having accepted the applicable terms and conditions of use, including these Terms of Use, for Teambox at any time. Unless you can accept such terms of use, you can unfortunately not use Teambox.

5.3 To the extent that you upload material on the Platform, you grant Teambox a right of use for such material so that Teambox can discontinue its services. You warrant that you have the necessary rights to grant Teambox such right of use.

6. INQUIRIES PER. E-MAIL
6.1 By accepting these Terms of Use, you consent to Teambox sending out an e-mail to the e-mail address that you have linked to your user account in the Platform.

6.2 Such e-mails may, subject to your separate consent, contain advertising material.

6.3 By accepting these Terms of Use, you consent to Teambox sending you push messages on your smartphone. You can change this at any time in the system settings of your smartphone.

7. PAYMENTS
7.1 If you as a user associate the possibility of receiving and sending payments from your user account, you must be aware that this is done on the basis of an agreement that you enter into with a third party.

7.2 Teambox is not responsible for all matters relating to such payments.

8. LIMITATION OF LIABILITY
8.1 The platform is made available as it is and is in its current form. Teambox strives to make the Platform available at all times, but Teambox does not guarantee this. Teambox cannot be held responsible for lack of access to the Platform, other operational disruptions, system crashes or the like. However, Teambox seeks at all times to avoid errors, omissions and operational disruptions on the Platform.

8.2 Any use of the Platform is at the user’s own risk and at his own risk. Teambox can in no case be held liable for users’ use of or lack of access to the Platform.

8.3 Teambox is not responsible for the accuracy or completeness of information contained on the Platform. In no event shall Teambook be liable for any loss incurred as a result of any acts or omissions made in reliance on the information contained in the Platform. Furthermore, Teambox is not responsible for data and other information that appears on Internet sites linked to from Teambox and the Platform.

8.4 Teambox may in no case be held liable for indirect losses, including, but not limited to, consequential damages, lost earnings, operating losses, loss of data or other losses to you as a user or to a third party.

8.5 Should Teambox, notwithstanding the above limitations of liability, become liable for damages, Teambox’s liability is at all times limited to an amount corresponding to what you as a user have paid for the use of the Platform within the last 6 months prior to the loss, but never more than one total amount of DKK 1,000.00.

In the event that you have used the Platform free of charge and thus not paid for the use, Teambox’s liability is at all times limited to a total amount of DKK 1,000.00.

9. CHANGE OF USER TERMS
9.1 Teambox is entitled to make changes to the Terms of Use on an ongoing basis and possibly fees and prices. If Teambox makes changes to the Terms of Use, users will be notified of the changes by sending an information e-mail to the e-mail address provided in the user account at least 30 days before the change takes effect. You will also be informed of the changes at your next log-in to the Platform.

9.2 Changes, cf. 9.1, includes the following changes:

9.2.1 Introduction of payment for the Platform

9.2.1.1 In the event that payment has been introduced for the Platform, cf. 9.2.1, Teambox may also make changes in prices and fees in the following situations:

9.2.1.1.1 Teambox makes major investments to improve your experience of the Platform, which i.a. may include improving and developing the Platform’s features or hiring more staff.

9.2.2 General changes to the Terms of Use to ensure that Teambox complies with the applicable legislation at all times.

9.2.3 New factual or private law matters necessitate a change in the terms of trade, including practical security matters.

9.3 If you do not accept the revised terms of use, you will not be able to use the Platform.

10. CHANGES TO THE PLATFORM ETC.
10.1 Teambox is at any time entitled to make changes in the Platform, including deleting and changing functions in the Platform. Teambox may cease offering the Platform without notice and any liability.

10.2 Teambox will try to notify you of changes in the Platform in good time.

11. DISPUTE RESOLUTION
11.1 Any dispute between Teambox and you shall, as far as possible, be settled amicably.
11.2 If a dispute between Teambox and you cannot be settled amicably, the dispute must be settled in accordance with Danish law at the court in Roskilde.

12. VERSION
These are the Teambox Terms of Service [version 1 of April 16, 2021].

PERSONAL DATA POLICY FOR TEAMBOX

This personal data policy for Teambox (hereinafter referred to as the “Personal Data Policy”) is intended to inform you about the processing of your personal information on the platform Teambox (the “Platform”) and Teambox.dk (the “Website”).

WHAT PERSONAL INFORMATION DO WE COLLECT?
In connection with the creation of a user on the Platform and the actual use thereof, we collect and process the following general personal information about you:

• Name
• Email
• Account information (only fine administrator)
• Gender
• Date of birth
• Language
• Picture
• Information provided in any communication between you and Teambox
• Location (geographical location), including when entering postcode and country of residence
• How you use our Platform and website, which mobile device you use, your operating system and your IP address, including information about traffic, location, behavior and other communication information
• Activities and events, including fines, payments and registrations of the day’s player, etc.

WHERE DO WE COLLECT YOUR PERSONAL INFORMATION FROM?
We collect your personal information from you if you enter your personal information in the Platform, either at creation or later. If you choose to create a user using Facebook or Apple ID, your personal information will be collected from your Facebook or Apple profile.

We may also collect the personal information if you write to us, use the Website or participate in customer surveys that we have organized.

FOR WHAT PURPOSE DO WE PROCESS YOUR PERSONAL INFORMATION?
We process your personal information for one or more of the following purposes:

• So you can create a user on the Platform
• So you can use the Platform
• Development and administration of the Platform, the Website and our business using data and statistics analysis
• Marketing, including newsletters, if we have been given permission to do so. We use cookies and similar technology for the Website. You can find more information about this in our cookie policy.
• Customer service and administration
• Communication of necessary information about the Platform, including functionality, etc.
• You visit the Website

ON WHAT LEGAL BASIS IS YOUR PERSONAL INFORMATION PROCESSED?
We collect and process your personal information when

• You have entered into an agreement with us to use the Platform (create a user). We need to fulfill this personal data in accordance with the agreement, cf. Art. 6 pieces. 1 (b).

• You have given your consent for us to use your personal data for one or more specific purposes, cf. the nature of the Data Protection Regulation. 6 pieces. 1 (a) and
§ 10 of the Marketing Act.

• It is necessary to pursue our legitimate interests, cf. the nature of the Data Protection Regulation. 6 pieces. 1, letter f). This may be, for example, when we communicate with you, to improve our Platform or to prevent misuse or loss of data.

WHO DO WE DISCLOSE PERSONAL INFORMATION TO?
We do not pass on personal data to other data controllers unless there is a legal basis for this or you have consented to this. Typically, disclosure will / can be made to business partners, payment providers, public authorities, auditing firms, law firms, banks or insurance companies.

In addition, we use a number of third parties who store and process data on our behalf. These data processors are not entitled to use your personal information for their own purposes.

PERIOD OF STORAGE
Personal data is stored for the period permitted by law and we delete it when it is no longer needed to fulfill the purpose for which it was collected.

SECURITY
We have taken technical and organizational measures against your personal data being accidentally or illegally deleted, published, lost, degraded or come to the knowledge of unauthorized persons, misused or otherwise processed in violation of the law.

Personal data will not be transferred to countries outside the EU / EEA unless there is a secure basis for transfer.

RIGHT TO INSIGHT, CORRECTION, DELETION AND BLOCKING
With us, you always have the right to gain insight into what personal information is registered about you. You receive the personal information in a structured, commonly used and readable format.

You also have the right to demand correction, deletion or blocking of information that is incorrect, misleading or similarly treated in violation of the law, unless we have another legal purpose.

If you want to be deleted from a fine box, you can contact the administrator who is responsible for the specific fine box on the Platform. However, your user will remain active and you have the opportunity to be associated with a new fine box.

If you want to correct your information or delete your user from the Platform, this can be done under “My Profile”. If you delete your user, but you have arrears in the form of unpaid fines, a notification will be left with the amount due at the time of deletion. However, your user information will not appear with the notification.

RIGHT TO OBJECT
In the event that your personal data is processed in order for us to pursue a necessary and legitimate interest, or if your personal data is used for direct marketing, you also have the right to object to processing, after which we will no longer process your personal data, unless we have another legal purpose.

CONSENT
In the event that we process your personal data on the basis of a consent, you can notify us at any time that you wish to withdraw your consent, after which we will no longer process your personal data unless we have another legal purpose.

However, you should be aware that if you withdraw a consent, we will no longer be able to exercise our obligations to you.

COMPLAINT
Complaint regarding. processing of personal data must be done to the Danish Data Protection Agency, Borgergade 28, 5, 1300 Copenhagen K. Further guidance and information can be found at www.datatilsynet.dk.

QUESTIONS AND EXERCISE OF RIGHTS

CHANGES TO PERSONAL DATA POLICY
We are at all times entitled to make changes to this Personal Data Policy. If we make changes to the Personal Data Policy, you will be informed of this per. e-mail, just as you will be informed about this at your next login on the Platform.

If you do not accept the revised Personal Data Policy, you will not be able to continue using the Platform.

Denne persondatapolitik for Teambox (herefter benævnt ”Persondatapolitikken”) har til formål at oplyse dig om behandlingen af dine personoplysninger på platformen Teambox (”Platformen”) og Teambox.dk (”Webstedet”).

HVILKE PERSONOPLYSNINGER INDSAMLER VI?
I forbindelse med oprettelse af en bruger på Platformen og selve brugen heraf indsamler vi og behandler følgende almindelige personoplysninger om dig:

• Navn
• E-mail
• Kontooplysninger (alene administrator af bødekassen)
• Køn
• Fødselsdato
• Sprog
• Billede
• Oplysninger afgivet i evt. kommunikation mellem dig og Teambox
• Lokation (geografisk placering), herunder ved indtastning af postnummer og bopæls-land
• Hvordan du bruger vores Platform og hjemmeside, hvilken mobil enhed du benytter, dit operativsystem og din IP-adresse, herunder oplysninger om trafik, placering, adfærd og andre kommunikationsoplysninger
• Aktiviteter og hændelser, herunder bøder, betalinger og registreringer af dagens spiller mv.

HVOR INDSAMLER VI DINE PERSONOPLYSNINGER FRA?
Vi indsamler dine personoplysninger fra dig selv, hvis du selv indtaster dine personoplysnin-ger i Platformen, enten ved oprettelsen eller senere hen. Hvis du vælger at oprette en bruger ved hjælp af Facebook eller Apple ID, indsamles dine personoplysninger fra din Facebook eller Apple profil.

Vi kan også indsamle personoplysningerne, hvis du skriver til os, bruger Webstedet eller del-tager i kundeundersøgelser, som vi har organiseret.

TIL HVILKET FORMÅL BEHANDLER VI DINE PERSONOPLYSNINGER?
Vi behandler dine personoplysninger til et eller flere af følgende formål:

• Så du kan oprette en bruger på Platformen
• Så du kan anvende Platformen
• Udvikling og administration af Platformen, Webstedet og vores forretning ved hjælp af analyse af data og statistikker
• Markedsføring, herunder nyhedsbreve, hvis vi har fået tilladelse til det. Vi anvender cookies og lignende teknologi til Webstedet. Du kan finde yderligere oplysninger herom i vores cookie-politik.
• Kundeservice og administration
• Kommunikation af nødvendige oplysninger om Platformen, herunder funktionalitet mv.
• Du besøger Webstedet

PÅ HVILKET RETSGRUNDLAG BEHANDLES DINE PERSONOPLYSNINGER?
Vi indsamler og behandler dine personoplysninger, når

• Du har indgået en aftale med os om brug af Platformen (opretter en bruger). Disse personoplysninger har vi brug for at opfylde aftalen, jf. databeskyttelsesforordningens art. 6, stk. 1, litra b).

• Du har givet dit samtykke til, at vi må bruge dine personoplysninger til et eller flere bestemte formål, jf. databeskyttelsesforordningens art. 6, stk. 1, litra a) og
markedsføringslovens § 10.

• Det er nødvendigt for at forfølge vores legitime interesser, jf. databeskyttelsesforord-ningens art. 6, stk. 1, litra f). Det kan fx være, når vi kommunikerer med dig, for at forbedre vores Platform eller for at forhindre misbrug eller tab af data.

HVEM VIDEREGIVER VI PERSONOPLYSNINGER TIL?
Vi videregiver ikke personoplysninger til andre dataansvarlige, medmindre der er lovligt grundlag herfor, eller du har samtykket hertil. Typisk vil/kan videregivelse ske til samarbejdspartnere, betalingsudbyder, offentlige myndigheder, revisionsfirmaer, advokatfirmaer, pengeinstitutter eller forsikringsselskaber.

Vi benytter os derudover af en række tredjeparter, der opbevarer og behandler data på vegne af os. Disse databehandlere er uberettigede til at anvende dine personoplysninger til egne formål.

PERIODE FOR OPBEVARING
Personoplysninger opbevares i det tidsrum, der er tilladt i henhold til lovgivningen, og vi sletter dem, når de ikke længere er nødvendige til opfyldelse af det formål, hvortil de er indsamlet.

SIKKERHED
Vi har truffet tekniske og organisatoriske foranstaltninger mod, at dine personoplysninger hændeligt eller ulovligt bliver slettet, offentliggjort, fortabt, forringet eller kommer til uvedkommendes kendskab, misbruges eller i øvrigt behandles i strid med lovgivningen.

Der overføres ikke personoplysninger til lande udenfor EU/EØS, medmindre der er et sikkert overførselsgrundlag.

RET TIL INDSIGT, BERIGTIGELSE, SLETNING OG BLOKERING
Hos os har du altid ret til at få indsigt i hvilke personoplysninger, der er registreret om dig. Du modtager personoplysningerne i et struktureret, almindeligt anvendt og læsbart format.

Du har endvidere ret til at kræve berigtigelse, sletning eller blokering af oplysninger, der er urigtige, vildledende eller på lignende måde behandlet i strid med lovgivningen, medmindre vi har et andet lovligt formål.

Hvis du ønsker at blive slettet fra en bødekasse, kan du henvende dig til den administrator, der står for den specifikke bødekasse på Platformen. Din bruger vil dog fortsat være aktiv, og du har mulighed for at blive tilknyttet en ny bødekasse.

Hvis du ønsker at rette dine oplysninger eller slette din bruger fra Platformen, kan det gøres under ”Min Profil”. Hvis du sletter din bruger, men du har restance i form af ubetalte bøder, vil der efterlades en notifikation med det skyldige beløb på tidspunktet for sletningen. Dine brugeroplysninger vil dog ikke figurere med notifikationen.

RET TIL AT GØRE INDSIGELSE
I tilfælde af, at dine personoplysninger behandles for, at vi kan forfølge en nødvendig og legitim interesse, eller hvis dine personoplysninger anvendes til direkte markedsføring, har du endvidere ret til at gøre indsigelse mod behandling, hvorefter vi ikke længere vil behandle dine personoplysninger, medmindre vi har et andet lovligt formål.

SAMTYKKE
I tilfælde af, at vi behandler dine personoplysninger på baggrund af et samtykke, kan du til enhver tid meddele os, at du ønsker at tilbagetrække dit samtykke, hvorefter vi ikke længere vil behandle dine personoplysninger, medmindre vi har et andet lovligt formål.

Du skal dog være opmærksom på, at såfremt du tilbagetrækker et samtykke, vil vi ikke længere have mulighed for at udøve vores forpligtelser overfor dig.

KLAGE
Klage vedr. behandling af personoplysninger skal ske til Datatilsynet, Borgergade 28, 5, 1300 København K. Nærmere vejledning og information kan findes på www.datatilsynet.dk.

SPØRGSMÅL OG UDØVELSE AF RETTIGHEDER

ÆNDRINGER TIL PERSONDATAPOLITIKKEN
Vi er til enhver tid berettiget til at foretage ændringer i denne Persondatapolitik. Såfremt vi foretager ændringer i Persondatapolitikken, vil du blive orienteret om dette pr. e-mail, ligesom du vil blive orienteret om dette ved dit næstkommende log-in på Platformen.

Hvis ikke du accepterer den reviderede Persondatapolitik, har du ikke mulighed for forsat at anvende Platformen.
